Terms of Service

1. Subject and Acceptance

These Terms of Service govern the use of the Speenji application. By registering or using the App you accept these Terms and the Privacy Policy. If you do not accept them, you may not use the Service.

2. Service Provider

The Service is provided by Alexandru Francisc Mihalache (a natural person). Contact: support@speenji.it.

3. Description of the Service

Speenji is a workout-tracking app: you create plans, log workouts, track progress, optionally connect to Apple Health and share plans/workouts with other users. It is offered in a free version and a paid Premium subscription. We may add, change or suspend features over time.

4. Account and Registration

To use the App you create an account with true and complete data. You are responsible for keeping your credentials confidential and for activity under your account. You must be at least 14 years old. Notify us promptly of any unauthorized use of your account.

5. Premium Subscription, Prices and Withdrawal

  • Premium is available as a subscription (monthly or yearly) purchasable through Apple's App Store.
  • Payment, automatic renewal and billing are handled by Apple under your App Store account terms. The price is the one shown in the App at the time of purchase.
  • The subscription renews automatically unless cancelled at least 24 hours before the end of the current period, from your App Store account settings.
  • Right of withdrawal (EU consumers): the law provides 14 days for digital content/services; by starting to use the content you may waive this right as provided by law. Refunds for App Store purchases are handled by Apple under its policies.

6. Acceptable Use

You agree not to: use the Service for unlawful purposes; infringe others' rights; attempt unauthorized access to other users' systems or data; upload unlawful, offensive or harmful content; use the friends feature for harassment or spam; circumvent security measures or perform reverse engineering not permitted by law.

7. User Content and Sharing

You remain the owner of the content you enter (plans, notes, etc.). You grant us a limited, non-exclusive, free licence necessary to provide the Service (store and display your data, or transmit to another user a plan you choose to share). When you share content you are responsible for what you share.

8. Intellectual Property

The App, the Speenji brand, the software, graphics and content are protected and remain owned by the provider or their respective owners. You acquire no rights in the App beyond the personal, non-transferable licence granted here.

9. No Medical Advice

Speenji is a fitness tool and is not a medical device, nor does it provide medical advice, diagnosis or treatment. The data shown (including data possibly imported from Apple Health, such as heart rate) is for informational purposes. Consult a doctor before starting a training program, especially if you have health conditions. You use the App at your own risk.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of error-free operation, continuous availability or fitness for a particular purpose, to the extent permitted by law.

11. Limitation of Liability

To the maximum extent permitted by law, the provider is not liable for indirect, incidental or consequential damages arising from the use or inability to use the Service. Nothing in these Terms limits liability that cannot be excluded by law (e.g. wilful misconduct, gross negligence, personal injury, mandatory consumer rights).

12. Suspension and Termination

You can delete your account at any time from the App. We may suspend or close accounts that breach these Terms or the law, with notice where reasonably possible. On termination, your data is handled as per the Privacy Policy.

13. Changes to the Terms

We may update these Terms. Significant changes will be communicated (updated date, in-app notice and, where applicable, a request to re-accept on launch). Using the Service after the update, or the requested acceptance, constitutes acceptance of the new Terms.

14. Governing Law and Jurisdiction

These Terms are governed by Italian law. For consumers, the court of the place of residence or domicile remains competent if located in Italy, and the mandatory protections of the Consumer Code apply. For non-consumer users, the court of the provider's location is competent.
